APNewsBreak: EPA moves to ban some rodent poisons

WASHINGTON (AP) ? The Environmental Protection Agency is moving to ban the sale of a dozen rat and mouse poisons sold under the popular D-Con brand in an effort to protect children and pets.

The agency said Wednesday it hopes to reduce the thousands of accidental exposures that occur every year from rodent-control products. Children and pets are at risk for exposure because the products typically are placed on floors.

The agency had targeted a handful of companies two years ago, saying they needed to develop new products that are safer for children, pets and wildlife. All but Reckitt Benckiser Inc., manufacturer of D-Con, did so.

The company will have at least 30 days to request a hearing before an administrative law judge. If no hearing is requested, the ban will take effect.

Eating bright-colored fruits and vegetables may prevent or delay amyotrophic lateral sclerosis

Jan. 29, 2013 ? New research suggests that increased consumption of foods containing colorful carotenoids, particularly beta-carotene and lutein, may prevent or delay the onset of amyotrophic lateral sclerosis (ALS). The study, published by Wiley in Annals of Neurology, a journal of the American Neurological Association and Child Neurology Society, found that diets high in lycopene, beta-cryptoxanthin, and vitamin C did not reduce ALS risk.

Carotenoids give fruits and vegetables their bright orange, red, or yellow colors, and are a source of dietary vitamin A. Prior studies report that oxidative stress plays a role in the development of ALS. Further studies have shown that individuals with high intake of antioxidants, such as vitamin E, have a reduced ALS risk. Because vitamin C or carotenoids are also antioxidants, researchers examined their relation to ALS risk.

According to the National Institutes of Neurological Disorders and Stroke (NINDS) roughly 20,000 to 30,000 Americans have ALS?also known as Lou Gehrig?s disease?and another 5,000 patients are diagnosed annually with the disease. ALS is a progressive neurological disease that attacks nerve cells (neurons) in the brain and spinal cord, which control voluntary muscles. As the upper and lower motor neurons degenerate, the muscles they control gradually weaken and waste away, leading to paralysis.

?ALS is a devastating degenerative disease that generally develops between the ages of 40 and 70, and affects more men than women,? said senior author Dr. Alberto Ascherio, Professor of Epidemiology and Nutrition at Harvard School of Public Health in Boston, Mass. ?Understanding the impact of food consumption on ALS development is important. Our study is one of the largest to date to examine the role of dietary antioxidants in preventing ALS.?

Using data from five prospective groups: the National Institutes of Health (NIH)?AARP Diet and Health Study, the Cancer Prevention Study II-Nutrition Cohort, the Multiethnic Cohort, the Health Professionals Follow-up Study, and the Nurses? Health Study, researchers investigated more than one million participants for the present study. A total of 1093 ALS cases were identified after excluding subjects with unlikely food consumption.

The team found that a greater total carotenoid intake was linked to reduced risk of ALS. Individuals who consumed more carotenoids in their diets were more likely to exercise, have an advanced degree, have higher vitamin C consumption, and take vitamin C and E supplements. Furthermore, subjects with diets high in beta-carotene and lutein?found in dark green vegetables?had a lower risk ALS risk. Researchers did not find that lycopene, beta-cryptoxanthin, and vitamin C reduced the risk of ALS. Long-term vitamin C supplement intake was also not associated with lower ALS risk.

Dr. Ascherio concludes, ?Our findings suggest that consuming carotenoid-rich foods may help prevent or delay the onset of ALS. Further food-based analyses are needed to examine the impact of dietary nutrients on ALS.?

Judge OKs $4B BP oil spill criminal settlement

NEW ORLEANS (AP) ? A federal judge on Tuesday approved an agreement for BP PLC to plead guilty to manslaughter and other charges and pay a record $4 billion in criminal penalties for the company's role in the 2010 oil disaster in the Gulf of Mexico.

Before she ruled, U.S. District Judge Sarah Vance heard testimony from relatives of 11 workers who died when BP's blown-out Macondo well triggered an explosion on the Deepwater Horizon drilling rig and started the spill.

BP agreed in November to plead guilty to charges involving the workers' deaths and for lying to Congress about the size of the spill from its broken well, which spewed more than 200 million gallons of oil. Much of it ended up in the Gulf and soiled the shorelines of several states. The company could have withdrawn from the agreement if Vance had rejected it.

Neither the Justice Department nor BP presented arguments to the judge before her decision in New Orleans.

Vance said the plea deal was "just punishment" considering the risks of litigation for BP and the alternatives to the settlement. She told victims' relatives who were in court that she read their "truly gut-wrenching" written statements and factored their words into her decision.

"I've heard and I truly understand your feelings and the losses you suffered," she said.

She said she also believes BP executives should have personally apologized to family members.

"I think BP should have done that out of basic humanity," she said.

The deal doesn't resolve the federal government's civil claims against BP. The company could pay billions more in penalties for environmental damage.

BP separately agreed to a settlement with lawyers for Gulf Coast residents and businesses who claim the spill cost them money. BP estimates the deal with private attorneys will cost the company roughly $7.8 billion.

For the criminal settlement, BP agreed to pay nearly $1.3 billion in fines. The largest previous corporate criminal penalty assessed by the Justice Department was a $1.2 billion fine against drug maker Pfizer in 2009.

The criminal settlement also includes payments of nearly $2.4 billion to the National Fish and Wildlife Foundation and $350 million to the National Academy of Sciences.

In a court filing before the hearing, attorneys for BP and the Justice Department argued that the plea agreement imposes "severe corporate punishment" and will deter BP and other deep-water drilling companies from allowing another disaster to occur.

The Justice Department has reached a separate settlement with rig owner Transocean Ltd. that resolves the government's civil and criminal claims over the Swiss-based company's role in the disaster.

Transocean agreed to plead guilty to a misdemeanor charge of violating the Clean Water Act and pay $1.4 billion in civil and criminal penalties. U.S. District Judge Jane Triche Milazzo has scheduled a Feb. 14 hearing to decide whether to accept that criminal settlement. A different judge will decide whether to accept Transocean's civil settlement.

Many relatives of rig workers who died in the blast submitted written statements that were critical of BP's deal. Twenty-eight-year-old Gordon Jones' family members said BP's sentence should include a personal, face-to-face apology to his widow and children by BP executives. A brother of Jones also had urged Vance to consider stiffer penalties that prohibit or limit the company's ability to operate in U.S. waters.

Vance, however, said she couldn't get involved in plea negotiations and only could impose a sentence that adheres to the agreed-upon terms if she accepted it.

Also killed were Jason Anderson, 35, of Midfield, Texas; Aaron Dale "Bubba" Burkeen, 37, of Philadelphia, Miss.; Donald Clark, 49, of Newellton, La.; Stephen Ray Curtis, 40, of Georgetown, La.; Roy Wyatt Kemp, 27, Jonesville, La.; Karl Kleppinger Jr., 38, of Natchez, Miss.; Keith Blair Manuel, 56, of Gonzales, La.; Dewey A. Revette, 48, of State Line, Miss.; Shane M. Roshto, 22, of Liberty, Miss.; and Adam Weise, 24, Yorktown, Texas.

Four current or former BP employees have been indicted on separate criminal charges. BP rig supervisors Robert Kaluza and Donald Vidrine are charged with manslaughter, accused of repeatedly disregarding abnormal high-pressure readings that should have been glaring indications of trouble just before the blowout.

David Rainey, BP's former vice president of exploration for the Gulf of Mexico, was charged with withholding information from Congress about the amount of oil that was gushing from the well.

Former BP engineer Kurt Mix was charged with deleting text messages about the company's spill response.

A series of government investigations have blamed the April 20, 2010, blowout on time-saving, cost-cutting decisions by BP and its partners on the drilling project.

The market lacked inspiration from Wall Street, where the

S&P 500 index eased slightly after an eight-day run of gains.

The Straits Times Index was down 0.11 percent at

3,271.27 points. The MSCI index of Asia-Pacific shares outside

Japan was up 0.7 percent.

Noble fell 2.8 percent to S$1.215, while SingTel gained 0.87

percent to S$3.48. Noble was suspended from Argentina's grains

register for an investigation into unpaid taxes, according to a

media report.

"The fall is a knee-jerk reaction to the suspension but it

is unlikely to be material," said a trader.

"The index seems to be stuck in the range of 3250-3280,"

said OCBC investment analyst Carey Wong, adding that the market

is awaiting results from property firms for direction.

Property firms have been in play recently after the

Singapore government introduced new measures to cool the

residential property market.

The move triggered selling in most property stocks, but the

larger ones such as CapitaLand have rebounded.

Stan Musial remembered during funeral Mass

ST. LOUIS (AP) -- Stan Musial was remembered during a funeral and memorial outside Busch Stadium on Saturday as a Hall of Famer and a St. Louis icon embraced by generations of fans who never had the privilege of watching him play.

Broadcaster Bob Costas, his voice cracking with emotion at times, pointed out during a two-hour Mass that in 92 years of life, Stan the Man never let anyone down.

Costas noted that even though Musial, who died Jan. 19, was a three-time NL MVP and seven-time batting champion, the pride of Donora, Pa., lacked a singular achievement. Joe DiMaggio had a 56-game hitting streak, Ted Williams was the last major leaguer to hit .400, and Willie Mays and Mickey Mantle soared to stardom in the New York spotlight. Musial didn't quite reach the 500-homer club - he finished with 475 - and played in his final World Series in 1946, ''wouldn't you know it, the year before they started televising the Fall Classic!''

''What was the hook with Stan Musial other than the distinctive stance and the role of one of baseball's best hitters?'' Costas said. ''It seems that all Stan had going for him was more than two decades of sustained excellence as a ballplayer and more than nine decades as a thoroughly decent human being.

''Where is the single person to truthfully say a bad word about him?''

There was enough room in the large Roman Catholic church for a handful of fans. One of them wore a vintage, No. 6 Musial jersey. Another clapped softly as pallbearers carried the casket from the church to the hearse to the tune of bagpipes.

Among those in attendance were baseball Commissioner Bud Selig, former St. Louis standout Albert Pujols and Hall of Famers Bob Gibson, Lou Brock, Ozzie Smith, Bruce Sutter, Whitey Herzog and 90-year-old Red Schoendienst, who once roomed with Musial. Joe Torre, a former MVP and manager in St. Louis, and Tony La Russa, who became close with Musial during his 16 seasons managing the Cardinals, sat near the front along with current manager Mike Matheny.

Pujols, who had been on track to challenge many of Musial's franchise records before signing with the Angels 13 months ago, exchanged hugs with Fred Hanser, a member of the Cardinals ownership team, before taking his seat.

Jim Edmonds, a star center fielder for two World Series teams in the 2000s, has the same last name as one of Musial's sons-in-law. He said Musial informed him that they were distant relatives, and greeted him as ''Hey, Cuz!''

''I thought he was kidding at first,'' Edmonds said. ''That's pretty cool.''

Jack Clark, a slugging first baseman for the Cardinals during the 1980s, said he perhaps respected Musial most for his decency during baseball's sometimes difficult period of integration in the 1940s and 1950s.

''Stan kind of crossed that color barrier. When people were getting on the African-American players, he stuck up for them. It was a time when you could kind of get your finger pointed at you for that stuff,'' Clark said. ''People loved him, and he loved them right back.''

Bishop Richard Stika, pastor at Musial's' church in suburban St. Louis for several years, speculated during the homily about why Musial was never ejected from a game during his career: ''I think deep down, that was because he didn't want to go home and face Lil.''

Musial's wife of nearly 72 years, Lillian, died last year.

Grandson Andrew Edmonds said the public Musial was no different from the private Musial, the grandpa who bought McDonalds for the family every Sunday. He recalled a fan telling him, ''Your grandpa's best attribute is he made nobodies feel like somebodies.''

Pallbearers included Cardinals President Bill DeWitt III, Musial grandsons Andrew Edmonds and Brian Schwarze, and the retired star's longtime business partner in Stan the Man Inc., Dick Zitzmann.

After the service, the hearse and vans filled with the Cardinals' delegation drove to Busch Stadium, where Musial's family laid flowers at the base of one of his statues - the one that made the move across the street from the old Busch - while being serenaded by ''Take Me Out to the Ball Game.'' Color guards from the city's fire and police departments flanked the statue, along with more than a dozen ballpark ushers. A single Clydesdale walked slowly down the street.

Cardinals closer Jason Motte shook his head.

''This is nothing like I've ever seen,'' he said.

During a funeral that was almost entirely upbeat, son-in-law Martin Schwarze got the biggest laugh when he recounted a 1995 radio interview with Jack Buck during which Musial was asked how good of a hitter he'd have been had he played in the modern era. Musial, who finished with a .331 career batting average, replied he probably would have batted about .275, and Buck said ''Whoa, whoa, whoa,'' that's way too low.

Then Musial added with a chuckle, ''Hey, Jack, I'm 75!''

Thousands filed through the Cathedral Basilica at Musial's six-hour public visitation on Thursday, and hundreds more attended the service.

Hundreds more were waiting at the more prominent of the two Musial statues outside Busch Stadium, where fans have gathered since Musial died after several years of declining health. Next to the statues were flowers, balloons, teddy bears, helmets, autographed items and a homemade sign that read ''Thanks for the memories. You live in our hearts, No. 6.''

''He's been a hero to us for four generations,'' Kathy Noorman of Wentzville, Mo., said, speaking near the statue. ''He was such a good man, somebody you can hold up to grandkids and your own kids as an example of who they should be.''

Mark Springman, 57, of Alton, Ill., brought a bottle of champagne to the statue shrine. He saw Musial play in 1963, Stan the Man's final season, and has been a season-ticket holder for about 15 years.

''He was more than a ballplayer,'' Springman said. ''He was the man.''

Katrina survivor moves 'Idol' judges to tears

There aren?t many events in recent years that touched Americans more than Hurricane Katrina, and there aren?t many reality competitions that understand the art of building an audience like ?American Idol.? It should be no surprise that the two met in the Baton Rouge auditions, to produce one of the best performances thus far in season 12.

Burnell Taylor, an unemployed 19-year-old from New Orleans, lost everything during the storm and moved with his family to Baton Rouge in the aftermath. Photos helpfully provided to the audience showed the devastation of his household, but Taylor noted one positive that came from the experience.

?I realized I knew how to sing after Hurricane Katrina,? Taylor said.

Taylor proved it with a stirring performance of ?I?m Here? that closed the show with perhaps the best performance of the season. It got a standing ovation from three of the four judges (Nicki Minaj stayed seated) and made Mariah Carey cry.

?All I can say is somewhere there?s a spotlight right now just waiting for you to walk into it,? Keith Urban said.

?That is what we came for,? Minaj said. ?I feel like we?ve been flying all around this country for that. That thing that can?t even be put into words. That thing that gives everybody chills and goosebumps. I?m so happy you did that because that wasn?t even an audition, that was just entertainment for us.?

Which begs the question -- what would cause Minaj to stand? And how dare she bring up ?goosebumps,? which we all hoped had been retired along with Jennifer Lopez.

Apart from that, Baton Rouge was filled with folks who were more quirky than inspiring.

I mean, it?s great that Ms. Greater Baton Rouge (Megan Miller) went against her doctor?s advice, risked infection, and hobbled in on crutches and sporting a wicked knee brace. But ?Idol? has dealt with a lot more serious health concerns in recent seasons. Just ask Phillip Phillips, Crystal Bowersox and Casey Abrams.

Charlie Askew was unexpected because he was so socially awkward, but ?Idol? takes guys like him every year and they always seem to do surprisingly well. After all, doesn?t everyone feel socially awkward at times? Especially teenagers?

Maddie Assel became the latest singer nominated by a family member and dragged out of their hometown by Randy Jackson to get four yes votes and a trip to Hollywood. It?ll be interesting to see how she and the rest of the shy types who needed that extra push to try out do in the more intense atmosphere of the next round.

We had firefighter Dustin Watts, but there are firefighters, policemen and the like every year. And Dr. Calvin Peters sang well, but it?s not like there was a lot at stake for him. If he washes out on the first day in Hollywood, he?s still a doctor, plus he has the advantage that any pressures the ?Idol? producers put on him can?t match what he needed to get through medical school.

No, it was Taylor who stole the show, and who will be Baton Rouge auditioner everyone remembers.

"John Dies at the End" review: Hipster Ghostbusters vs. Flying Mustaches

LOS ANGELES (TheWrap.com) - A shaggy-dog story with restless leg syndrome, "John Dies at the End" may not amount to much, but there's no denying its sheer entertainment value. Mixing slacker laughs with inter-dimensional creepy-crawlies, it's a zing-packed horror comedy that coasts by on sheer bravado, twisted wit and endless adrenaline.

Cult writer-director Don Coscarelli ("Bubba Ho-Tep," "The Beastmaster," "Phantasm") drolly adapts the novel by David Wong (a pen name for Jason Pargin), and even if the story's rules and logic seem to be ever-shifting, it never feels like the movie is cheating or pulling the rug out. We're set up for a lunatic funhouse of a plot, and that's exactly what we get.

Dave (Chase Williamson) meets with reporter Arnie Blondestone (Paul Giamatti, who also executive produced) to tell him of his recent extraordinary adventures that saved the universe as we know it. Or something like that. His journey involves a street drug known as "soy sauce," which gives its users superhuman powers of perception and the ability to see the future and to travel between dimensions.

Dave's best friend John (Rob Mayes) takes the drug and then dies (in the middle, actually), only to find other forms in which to exist before manifesting inside a dog and then back into his own corpse, and...

Look, there's no way to really explain this story without note cards and a flow chart; suffice it to say that Dave and John encounter a variety of bizarro occurrences, including a bratwurst that acts as a cell phone, teenagers possessed by what look like fruitflies, a flying mustache, a monster made of frozen meat, an infomercial psychic (played by Clancy Brown) who may hold the keys to the mysteries of existence, and a cop (Glynn Turman of "Gremlins") who wants to set everyone and everything that's been exposed to the drug on fire before they can create any more trouble.

"John Dies at the End" seems to be designed for multiple viewings, as it pretty much dissolves inside your brain the second it's over, but there's no denying the little pops of pleasure it provides along the way. Relative newcomers Williamson and Mayes make charismatic tour guides in this crazy world, and their ability to anchor material this flimsy and seemingly unmanageable speaks well for their futures as actors in more narratively stable films.

Giamatti gets the relatively thankless as-told-to role, but he's clearly having a ball in his ill-fitting schlub costume; if nothing else, he does "And then what happened?" about a hundred times more interestingly than Rafe Spall does in "Life of Pi."

This movie may, in the final analysis, be nothing but stoner silliness with the occasional gross-out. But if you happen to be in the market for stoner silliness with the occasional gross-out, "John Dies at the End" does it particularly well.

Neo Geo X still in production, Tommo plans to add 'more games, peripherals and software updates'

Despite reports claiming that Tommo Inc's portable re-launch of the Neo Geo had ceased production, that is apparently not the case. "There has been a recent rumor about the end of the production of the NEOGEO X System. This rumor is incorrect," Tommo told us in a statement. The reports apparently stem from ending production of the Limited Edition Neo Geo X Gold System, which Tommo says, "was always planned to be a limited edition product." Beyond just continued production of the standard model, Tommo adds that it'll be supporting the device with, "more games, peripherals, and software updates." The Limited Edition, however, will likely start to disappear by some point in April, when the company expects final stock to begin shipping. The NEOGEO X Gold System Limited Edition Collection Series that includes Ninja Masters, was always planned to be a limited edition product. We are currently manufacturing our final run of this Limited Edition Collection Series and our distributors worldwide expect to have the final stock in April. Cameron promises Britons straight choice on EU exit

LONDON (Reuters) - Prime Minister David Cameron promised on Wednesday to give Britons a straight referendum choice on whether to stay in the European Union or leave, provided he wins an election in 2015.

Cameron ended months of speculation by announcing in a speech the plan for a vote sometime between 2015 and the end of 2017, shrugging off warnings that this could imperil Britain's diplomatic and economic prospects and alienate its allies.

Cameron said Britain did not want to pull up the drawbridge and retreat from the world but that public disillusionment with the EU is at "an all-time high".

"It is time for the British people to have their say. It is time for us to settle this question about Britain and Europe," Cameron said. His Conservative party would campaign for the 2015 election promising to renegotiate Britain's EU membership.

"When we have negotiated that new settlement, we will give the British people a referendum with a very simple in or out choice to stay in the European Union on these new terms; or come out altogether. It will be an in-out referendum."

Cameron said he wants Britain to claw back some powers from Brussels, a proposal that other European countries reject. Britain would do an "audit" to determine what powers Brussels had that should best be delegated to member states.

Sterling fell to its lowest in nearly five months against the dollar on Wednesday as Cameron was speaking.

Whether Cameron will ever hold the referendum remains as uncertain as the Conservatives' chances of winning the next election due in 2015.

They trail the opposition Labour party in opinion polls, and the coalition government is pushing through painful public spending cuts to try to reduce Britain's large budget deficit, likely to upset voters in the meantime.

Cameron's promise looks likely to satisfy much of his own party, which has been split on the issue, but may create uncertainty when events could put his preferred option - a looser version of full British membership - out of reach.

The move may also unsettle other EU states, such as France and Germany. European officials have already warned Cameron against treating the bloc as an "a la carte menu" from which he can pick and choose membership terms.

The United States, a close ally, has said it wants Britain to remain inside the EU with "a strong voice".

The speech could also exacerbate rifts with Cameron's pro-European Liberal Democrat junior coalition partners.

Cameron said he would prefer Britain, the world's sixth biggest economy, to remain inside the 27-nation EU but he also made clear he believes the EU must be radically reformed. It was riskier to maintain the status quo than to change, he said.

"The biggest danger to the European Union comes not from those who advocate change, but from those who denounce new thinking as heresy," he said.

If Britain left the EU, Cameron said it would be "a one-way ticket, not a return", adding however that he would campaign to stay inside a reformed EU "with all my heart and soul".

"WAFER THIN" CONSENT

Cameron said the euro zone debt crisis was forcing the bloc to change, and Britain would fight to make sure new rules are fair to countries that do not use the common currency. Britain is the largest of the 10 EU members that do not use the euro.

Democratic consent for the EU in Britain was now "wafer thin", he said, reflecting the results of opinion polls that show a slim majority would vote to leave the bloc and the rise of the UK Independence Party that favors complete withdrawal.

"Some people say that to point this out is irresponsible, creates uncertainty for business and puts a question mark over Britain's place in the European Union," said Cameron. "But the question mark is already there: ignoring it won't make it go away."

Avoiding a referendum would make an eventual British exit more likely, not less, he said.

"Simply asking the British people to carry on accepting a European settlement over which they have had little choice is a path to ensuring that when the question is finally put - and at some stage it will have to be - it is much more likely that the British people will reject the European Union."

Asked after the speech whether other EU countries would agree to renegotiate Britain's membership, Cameron said he was an optimist and that there was "every chance of success."

"I want to be the prime minister who confronts and gets the right answer for Britain on these kind of issues," he said.

Cameron's speech has been marked by long delays and was postponed from last week due to the Algerian hostage crisis.
